3 adjacent land parcels totaling 13 +/- Acres for development in Southwest Phoenix, Arizona for auction in conjunction with Real Estate Nation.
TERMS AND CONDITIONS
The seller and Real Estate Nation reserve the right to remove the property from the auction should circumstances require or postpone or cancel the auction at the seller’s discretion.
The seller reserves the right to reject any and all bids, to waive any informalities or irregularities in any bid and assumes no responsibilities for errors in listings.
Property will be sold on an as-is basis
Although information has been obtained from sources deemed reliable, the sellers and Real Estate Nation, LLC their respective representatives, attorneys, agents or subagents, make no guarantee to the accuracy of the information herein contained in any other property listing, files, or advertising or promotional publicity statement and material. It is the responsibility of the buyer to inspect the property prior to bidding at the auction to determine property condition, including any possible zoning or code violations.
Costs and Prorations
All real estate taxes and other taxes that are liens against the real estate and all assessments due and payable during the year of Closing shall be prorated as of the Closing Date. Seller shall pay for preparation of the Deed and for all transfer and documentary stamp taxes for the Deed. The buyer shall pay the cost of recording the Deed. Rents and any other income, if any, shall be prorated to Closing Date. All deposits shall be delivered at Closing. Seller and the buyer shall pay their own closing costs and expenses. Seller makes no representations or warranties as to personal property which may be present on property Buyer assumes all risk to disposed of such property. Seller makes no representations as to tenancey of property. Buyer assumes all risk to remove any tenant which may exist and shall bear all risk of loss to the Property; (c) Seller has read, understands and agrees to all of the terms of this Contract; (d) Seller shall, on the Closing Date, deliver the signed General Warranty Deed and all other title documents necessary to transfer clear title to and full possession of the Property to the Buyer,.
The property is offered for sale to qualified buyers without regard to prospective buyer’s race, age, sex, religion, national origin, physical handicap or marital status.
Property may be inspected by interested parties during preview times or by appointment.
A 10% Buyer’s Premium will be added to the high bid price at the auction for the final purchase price.
Real Estate Broker Participation is encouraged. A commission equal to 3% of the high accepted bid price (exclusive of any buyer’s premium) will be paid to a qualified real estate broker licensed in the state of Arizona. When the broker’s properly registered client’s bid is accepted and the buyer purchases and closes on the property. To qualify for the commission, the broker MUST:
1. Be a qualified real estate broker and duly and actively licensed in the state of Arizona.
2. Register as the buyer’s representative on Real Estate Nation’s Broker Registration Form, and obtain both the prospective buyer’s and broker’s signatures. Full completed and executed forms must be received by Real Estate Nation at the Brokers email to firstname.lastname@example.org prior to bidding at the auction.
NOTE: Commission will be paid only to the first broker registering a prospect. Attempted registrations of the same prospect by additional brokers will not be accepted. Commissions, if any, will be due and payable only following closing on the property.
At the close of the auction, the high bidder will have 24 hours to deposit 10% of the final bid inclusive of of the buyers’ premium into escrow with Lawyers Title Company in care of Catherine Albo. If this deposit is not made , Seller and Real Estate Nation reserve the right to award the property to another bidder or continue to offer the property for sale.
Buyer must close on the property within 30 days. Sale will NOT be contingent upon financing. Sale must be coordinated with Seller’s title company.
