For All Users

When you use or access our website we collect the following information:

  1. Website Data. We may collect common usage data about the ways our users view our website and the information available on or by accessing our website.
  2. Cookies and Similar Data. We assign cookies to you when you use the website. These enable you to more efficiently use our website. This information may also be used to enhance our use of our website if you visit the website more than once and to assist us in the administration and use of the website. Additional Cookies may apply to Sellers, Bidders, and Winning Bidders.

Account Holders

For any User who sets up an account with Auction Nation, we will collect and use the following information:

In order to set up an account, you will be required to provide a user name, which will consist of either a bidder number and/or an email address. In addition, you will be required to set up a password in order to access your account. As part of establishing an account, you will also need to provide us with contact information, such as your name, email address, physical or mailing address, and telephone number. In most cases, a bidder number will also be established for you. As part of setting up an account, we may also require that you provide information or documentation to verify your identity. We may use procedures to verify the identity information you provide to us, including address verification procedures.

Bidder Information

In order to bid at an auction, as part of establishing your account, you will be required to provide credit card information. You may also be required to provide additional information to verify your identity and to verify your credit card information. We use industry-standard procedures to verify credit card information provided to us.

Your account will also include a record of any auctions you participate in, including, if you are a bidder, your bidding history for each auction, and whether or not you were the Winning Bidder.

If you are a Winning Bidder at any auction, your account will also include information regarding the auction you won, the auction property you won, and potentially shipping or delivery information related to the items purchased at auction. We will also have information regarding the amount you paid for the auction property. We also will retain information regarding any amounts charged to your credit card in accordance with our policies and the terms of bidding applicable to any particular auction. If you pay for any auction items where you are the Winning Bidder in any manner other than charging the auction price (plus any other applicable charges and fees) we will retain information regarding the amount paid and the method of payment.

For any Auction where you are the Winning Bidder, you may be required to provide identification to verify your identity at the time you take possession of the Item you won at an Auction.

If you voluntarily provide any other information to us, we reserve the right to keep, maintain, and use such information in any manner we deem appropriate.

For Auction Sellers

In addition to the information listed above applicable to all Users, we will collect the following information:

We will collect information about you, including your name, email address, physical or mailing address, and telephone number, and property you have listed for auction, including your contact information, information describing the property listed for action, any auction reserves you set, including the history of when the reserves were set, any changes to any auction reserves and whether, during any auction, the reserves were met, and when the property was sold at auction. We will also maintain any information you provide on the estimated value of the property listed for auction.

In your account, we may also include your history of listing property in our auctions and the type of auction held for your property.

We may also maintain information on the delivery of any Auction Item to the Winning Bidder and any reported delays or problems in transferring the Item to the Winning Bidder.

We will also maintain information regarding the amounts paid to you based on the Items sold at Auction and any related fees and charges paid by you and the method of payment to you.

To the extent required by law, we will report to any applicable legal authority, including taxing authorities, the amounts paid to you from the sale of your property at auction.

If we are required by law to withhold any amounts due and payable to you, we will withhold such amounts as legally required; and similarly, where legally required to do so, we will submit such withheld amounts to the appropriate legal authority. We will notify you of such activities as required.

Ways We Use the Information We Collect

  1. Account Information: We will use your account information to verify your identity and to confirm your account activities. This information will also be used in the aggregate to allow us to develop future products and services; to maintain and enhance the Platform and services we offer; and to ensure the effective administration of the Platform. This information may also be used for marketing and advertising purposes. Any information you provide to Auction Nation may be shared with any Affiliate, either individually or in the aggregate.
  2. Bidding Information: Bidding information is used to conduct the auctions on the Platform and to determine a winning bidder. This information will also be used to help develop more efficient and secure bidding auction systems in the future. This information may also be used for marketing and advertising purposes. Any information you provide to Auction Nation may be shared with any Affiliate, either individually or in the aggregate.
  3. Winning Bidder Information: Winning Bidder information will used to determine and verify the identity of the Winning Bidder and to enable the Seller to provide the action items won by the Winning Bidder to the Winning Bidder. This information will also be used where needed to provide shipping information for the Auction Items won by the Winning Bidder. Winning Bidder information may will be used to assist in having the Winning Bidder pay for the items won. Winning Bidder information may also be used for administrative purposes, and for regulatory compliance purposes. If there is any dispute regarding any auction, Winning Bidder information may also be used for resolving such dispute. Winning Bidder information may also be used by Auction Nation and its Affiliates for marketing purposes. Such information will not be shared with third parties.
  4. Seller Information: Seller information will be used to verify the identity of the Seller and to verify the Seller’s property being offered for auction and the description of such property. Seller information may also be used for marketing and advertising purposes. Some Seller information may also be used on an aggregate basis to monitor and enhance the Platform and the Services. Seller information may also be used by Auction Nation and its Affiliates for administrative and marketing purposes. Such information will not be shared with third parties.
  5. Cookies and Similar Data. This information is used to enhance your use of our website and services. This information may also be used to facilitate the use of the website and services and to assist us with the technology used on the website and providing the services. This information may also be used for marketing and advertising purposes. Any information you provide to Auction Nation may be shared with any Affiliate, either individually or in the aggregate.
  6. Information You Provide. We may use your name and email address to contact you regarding the services offered through our website or with the other services we provide. This information may also be used for marketing and advertising purposes. Any information you provide to Auction Nation may be shared with any Affiliate, either individually or in the aggregate.

Updating Your Personal Information

You may update your name and email address and any other information you have provided to us at any time by contacting us and providing updated information. You are required to maintain updated contact information with Auction Nation as long as you are using the Website or the Services. In addition, at any time you may request that we delete your information from our records and we will stop using that information and remove it from our records; except we will maintain your account information and credit card and financial information for as long as necessary to complete any financial transaction, and for a reasonable period thereafter to verify such financial transactions; for as long as reasonably necessary to complete any needed tax reporting or other legal and regulatory compliance; and as otherwise required by law.

Additional Disclosures of Information – Legal Requirements, etc.

We will disclose any information available to us, including your personal information, to the extent we have a good faith belief such action is necessary or appropriate in the following circumstances:

  1. Where disclosure is legally required;
  2. To cooperate with a proper request from any law enforcement agency;
  3. To comply with any applicable law, rule or regulation;
  4. To address any violation of our policies, including any violation of our Terms and Conditions or these policies;
  5. To detect, prevent or otherwise address any security or technical issue, or any fraudulent use of our services;
  6. To defend ourselves against any claim or lawsuit; or
  7. To protect ourselves, our users or the public against any harm or damage to their persons or property, or as required or permitted by law.

We further reserve the right to submit any information you provide us to any appropriate law enforcement agency if we believe any such information may indicate a crime has been committed or any property listed in any auction is illegal, counterfeit, or stolen, or any participant in any auction is using or has used the Platform in a criminal action or to further any criminal activity.

Data Security

We have appropriate security measures in place in our facilities to protect against the loss, misuse, or alteration of information that has been collected from you through the Platform. In addition, we use industry standard methods to prevent your information from being accessed without authorization.

Although we take reasonable steps to safeguard and prevent unauthorized access to your private information, we cannot be responsible for the acts of those who gain unauthorized access, and we make no warranty we will prevent unauthorized access to your private information.

IN NO EVENT WILL AUCTION NATION, LLC, OUR AFFILIATES OR OUR OR OUR AFFILIATES’ OFFICERS, DIRECTORS, SHAREHOLDERS, PRINCIPALS, MEMBERS, MANAGERS, OR OWNERS BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH A THIRD PARTY’S UNAUTHORIZED ACCESS TO YOUR INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT, OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER WE WERE GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.

We reserve the right to change these policies at any time, with or without notice. Any such changes will be posted on our website and will be effective upon such posting (unless the posting specifies a different effective date).
